Court Grants Final Approval to $82 Million Settlement in Drug Pricing Class Action
McCulley McCluer served as Plaintiffs' Executive Committee Counsel in a nationwide class action on behalf of self-insured local governmental entities (public payors) against the nation's largest drug wholesaler, McKesson, for allegedly inflating the prices of hundreds of brand-name drugs. After achieving certification of a RICO class and defeating an attempted Rule 23(f) appeal to the First Circuit Court of Appeals, Plaintiffs reached a $82 million settlement shortly before trial.
